Frequently Asked Questions

Yes, ASIC does charge a government fee to deregister the company, as well as any outstanding government fees attached to the company. Lawpath’s fee includes the ASIC government fee and a service fee to prepare and lodge your deregistration.
Yes, in order to deregister your company with ASIC, all outstanding fees need to be paid. This may include previous missed annual reviews and late penalty fees.
Once we receive the signed documentation, we will process your application within 24 hours. ASIC will mark your company as ‘Strike-Off Action in Progress,’ and the ASIC deregistration process will commence. It can take up to two months for ASIC to review your company details and update your company’s status to ‘Deregistered.’
Lawpath will provide you with Directors’ Resolution and Members’ Resolution to be signed. These documents will be used for your ASIC application and can be utilised as proof of deregistration.
When the company is deregistered, the ABN will also be cancelled. The company tax file number will also be marked as inactive with the ATO.
Any business names registered to a cancelled ABN will be ineffective to use. Business names can be transferred to a new owner, cancelled immediately or left to go through its registration period. They will be automatically cancelled after 2 months if not renewed.
